The Gist

A landmark ruling by the EU's highest court suggests that platforms like YouTube cannot claim passive intermediary status once they have actively vetted a creator's channel.

The European Union's top court has delivered a significant blow to Google’s legal protections regarding hosted content. The court ruled that YouTube may lose its status as a neutral intermediary if it takes an active role in reviewing or vetting specific creator channels.

The End of Passive Hosting?

Under long-standing legal frameworks, digital platforms have generally been shielded from liability for user-generated content, provided they act merely as 'passive hosts.' However, the court's latest interpretation suggests that once a platform engages in manual reviews or curation of a creator's output, it can no longer claim to be a neutral conduit.

Google had previously warned that such a shift in legal interpretation would complicate how platforms manage high-quality creators. The ruling implies that by vetting content, the platform gains 'knowledge and control' over it, potentially making the company legally responsible for copyright infringements or other illegal material found within those reviewed sections.
